課程概述 |
本課程將針對競爭法與智慧財產法二者間之相生與相剋關係，進行探討。在經濟時代中扮演的絕大重要角色之智慧財產，其權利行使之不當，可能反而會對知識經濟發展帶來不利影響，競爭法制對此類不當權利行使，可扮演何種制衡角色？實際上又扮演何種角色？乃為本課程探討之目標。

課程目標 |
藉由本課程之檢討，修習者當能初步瞭解競爭法與智慧財產法二者間之微妙關係，競爭法對於智慧財產法可發揮之制衡作用及界限，並對未來智慧財產法之運用及修正方向，有一定清楚之認識。本學期主要針對最近我國著作權法修正草案條文中，引起最大爭議之合理使用議題，藉由美國法文獻的閱讀，釐清合理使用規範原理及未來可能的發展方向。 | ||||||||||||||||||||||||
